Terms of Service

You must be at least 18 years old and capable of entering into a legally binding agreement to use the Service. By using the Service, you represent that you meet these requirements. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

To access the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately at legal@prismfy.io if you suspect unauthorized access.

Upon registration, you will receive one or more API keys to authenticate requests to the Service at https://api.prismfy.io. You must keep your API keys confidential and must not share them publicly (e.g., in public repositories, client-side code, or third-party services without access controls). You may create up to 10 API keys per account. You are responsible for all API calls made using your keys.

You agree not to use the Service to:

• Violate any applicable local, national, or international law or regulation;
• Conduct automated or bulk searches in excess of your plan's rate limits;
• Resell or redistribute raw API access to third parties without our prior written consent;
• Scrape, aggregate, or republish search results in a manner that violates the terms of underlying search engines;
• Attempt to reverse-engineer, bypass, or circumvent any security measure, rate limit, or quota enforcement;
• Transmit malicious code, spam, or any content that could harm the Service or other users;
• Use the Service to infringe any intellectual property rights of any third party.

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

The Service is offered under the following tiers: Free, Pro, and Enterprise. Plan details, quotas, and pricing are described on the Pricing page.

• Free tier: No payment required. Limited to 3,000 requests per month and 10 requests per minute.
• Pro tier: Billed monthly via Paddle. Your subscription renews automatically until cancelled. You may cancel at any time; access continues until the end of the current billing period.
• Enterprise tier: Custom pricing. Contact us at legal@prismfy.io for details.

All fees are exclusive of taxes. You are responsible for any applicable taxes in your jurisdiction. We reserve the right to change pricing with 30 days' notice.

Subscription fees are non-refundable except where required by applicable law. If you believe a charge was made in error, contact us at legal@prismfy.io within 14 days of the charge.

Each plan includes specific request quotas and rate limits. Requests that exceed your plan's rate limit (RPM) will receive a 429 Too Many Requests response. Requests served from cache do not count against your quota. We may adjust plan limits at any time and will notify affected users in advance.

We aim to provide reliable service but do not guarantee 100% uptime. The Service is provided “as is” and “as available”. We may perform maintenance, updates, or modifications that temporarily affect availability. For Enterprise customers, an SLA may be negotiated separately.

Prismfy retains all rights, title, and interest in the Service, including its underlying technology, trademarks, and documentation. You retain ownership of any data you submit via the API. You grant us a limited, non-exclusive license to process your queries solely for the purpose of delivering the Service.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of information as described therein.

Either party may terminate the agreement at any time. We may suspend or terminate your access immediately if you breach these Terms, fail to pay fees when due, or if we are required to do so by law. Upon termination, your API keys will be revoked and your data may be deleted after a 30-day retention period.

To the maximum extent permitted by applicable law, Prismfy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or in connection with the Service, even if advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the fees you paid to us in the three months preceding the claim.

The Service is provided “as is” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that results obtained will be accurate or reliable.

These Terms shall be governed by and construed in accordance with the laws of the European Union and the jurisdiction in which Prismfy is registered. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
